Finbar Excel add-in — End User Licence Agreement
The Finbar Excel add-in is provided by CEL TECHNOLOGIES LTD, registered in England and Wales under company number 15299259, at 128 City Road, London, EC1V 2NX (“Finbar”, “we” or “us”). This End User Licence Agreement (“EULA”) covers the add-in and the Finbar services you access through it, including free access, trials and paid features.
Which terms apply
This page and the applicable agreement below together form your EULA:
- Business use: our Business terms of service apply when you use Finbar for your trade, business, craft or profession. Those terms incorporate the Common Paper Cloud Service Agreement Standard Terms version 2.0, as modified by Finbar's cover page.
- Personal use: our Consumer terms of service apply when you use Finbar wholly or mainly outside your trade, business, craft or profession, including personal investment research. The business terms and Common Paper agreement do not apply to consumers.
Your actual circumstances determine which agreement applies, regardless of your account or plan label. Please read that agreement: it contains the rules on permitted use, customer content, fees, cancellation, warranties, liability and disputes.
If you use the add-in through an organisation's account, your use is subject to that organisation's agreement with Finbar. Anyone accepting an agreement on behalf of an organisation must have authority to do so. A separately signed agreement takes precedence for the services it covers.
Your licence and access
Subject to the applicable agreement, we grant you a non-exclusive licence to install and use the add-in to access Finbar within your account's permissions and plan limits. This includes any free access or trial we make available. Finbar and its licensors retain ownership of the add-in; your rights in content and outputs are governed by the applicable agreement.
Access to service features requires a Finbar account and may require a paid subscription. Installing the add-in does not itself purchase a subscription, authorise a charge or grant access to paid features. You also need a supported version of Microsoft Excel and any necessary Microsoft licence.
For free access, fees are zero. For business free access, the Order Date is the date you accept this EULA, and the Subscription Period is the free-access period stated when you accept or, if none is stated, continues until ended under the applicable agreement. For trials, the duration, limits and any conversion to a paid subscription must be disclosed and agreed before the trial starts. No payment is authorised merely by accepting this EULA.
Paid features, prices, billing periods and renewal arrangements are set out in the accepted order or checkout and governed by the applicable agreement. Uninstalling the add-in does not by itself cancel a Finbar subscription or delete your account. Use account billing or contact us to cancel as described in your terms.
Privacy and support
Our Privacy notice explains how we handle personal information, including workbook content and other information processed through Finbar. Our Data processing agreement forms part of the applicable agreement where Finbar acts as your processor or subprocessor.
For support or questions about these terms, contact inquiries@finbar.com. Finbar supplies and supports the add-in. Your use of Microsoft Excel and Microsoft Marketplace is also subject to your separate agreements with Microsoft.
Acceptance and how these documents fit together
This EULA takes effect when you accept it or enter an order that incorporates it. Merely viewing this page does not constitute acceptance. If you do not agree, do not use the add-in.
This page identifies the applicable agreement and extends its service scope to add-in installation, free access and trials. The free-access details above complete the business order details for that access; otherwise, the applicable agreement controls any conflict with this page. Its procedures govern subsequent changes to your agreement. Mandatory law and applicable transfer clauses prevail, and the DPA governs processing within its scope. Nothing here limits rights that cannot lawfully be excluded.
